Acceptance of Terms

These Terms of Service govern your use of the website aichristmas.io and the AI Christmas photo, card and video service offered on it (together, the "service"), operated by AI Christmas ("we", "us"). They apply to every visitor, guest and account holder. By accessing or using the service, you agree to these terms, our Privacy Policy, our Content Policy and our Refund Policy. If you do not agree, do not use the service.

Description of Service

The service lets you upload everyday photos of yourself, your family and your pets and turn them into festive, clearly AI-generated Christmas content:

• Christmas photos — a group portrait in one of our fixed Christmas scenes (for example a Christmas tree, matching pajamas or a snowy cabin), made from one photo per person or pet;
• Christmas cards — an online card shared by link, and a printable 5×7 card created in your browser;
• Christmas videos — a short 10-second clip that animates one of your Christmas photos with a fixed festive motion (waving, falling snow, unwrapping a gift), a fixed Christmas elf dance, or a fictional "Santa caught on camera" clip made from a photo of a room.

All content is generated by AI models on our behalf. Videos are created with Seedance (international version). You choose from fixed scenes and motions; you cannot write your own prompt, choose what anyone says, or clone a voice.

The service is independent and is not affiliated with or endorsed by OpenAI, Google, JibJab, Office Depot / Elf Yourself, or any other brand or rights holder. Santa Claus is a public-domain folk character.

Eligibility and Accounts

You must be at least 13 years old to use the service. If you are under 18, you may use it only with the permission of a parent or legal guardian, and purchases must be made by an adult (or by you with your parent's or guardian's consent). Children under 13 may not use the service themselves; they may appear in photos only when uploaded by their parent or legal guardian (see "Your Uploads").

You can use the service with an account or as a guest. A guest session is an anonymous account tied to your browser. If you buy as a guest, we deliver to the email you enter at checkout; you are responsible for entering an email you can access. When you sign in with that email, your guest purchases move to your account. You are responsible for keeping your login secure and for all activity under your account. Notify us promptly of any unauthorized use.

Your Uploads: Consent First

You may only upload a photo if:

• it shows you, or a person who has given you permission to use their photo for this purpose;
• for a child under 18, you are the child's parent or legal guardian (a 13–17-year-old may upload their own photo with a parent's or guardian's permission);
• it shows your own pet, or a pet whose owner agreed;
• you have the right to use the photo (you took it, or you have the photographer's permission);
• it does not show a public figure, such as a celebrity, athlete, influencer or politician; and
• it does not contain nudity, sexual content, violence, hate symbols, or another party's trademarks or copyrighted artwork as the main subject.

Before every generation you must confirm these conditions; the generator and our server reject requests without this confirmation. You are responsible for the photos you upload and the content you create from them.

You keep all rights you have in your photos. You grant us a limited, temporary license to store, process and transmit your photos and creations only as needed to provide the service to you, including sending them to our AI processing providers. This license ends when the content is deleted, which happens automatically within 7 days (see "Data Deletion").

Deepfake Prevention and Content Safety

We take a zero-tolerance approach to non-consensual deepfakes, impersonation, sexual content and any misuse involving minors. The service is designed for warm, obviously festive family keepsakes — not realistic footage of real people doing or saying things. These safeguards are in place today:

1. Consent confirmation before every generation, enforced on our server.
2. Fixed scenes and motions only. You cannot enter a prompt, change what happens, make anyone say specific words, or clone a voice. The service cannot place a person in an arbitrary scene or make them appear to do something compromising.
3. Automatic photo screening. Every upload is checked before generation; photos showing several people, or no clear person or pet, are blocked.
4. Provider safety checks. Our AI processing providers screen requests for sensitive and prohibited content. When a request is refused, the generation fails and your credits are returned automatically.
5. Visible AI context. Free previews carry a visible watermark, shared cards carry our name, and every output is a stylised Christmas scene that is plainly not a real photograph of real events.
6. Prohibited uses. You may not use the service, or anything made with it, to:
   • use another person's likeness without their consent;
   • impersonate anyone, or deceive people about who appears in an image or video;
   • create sexual, sexually suggestive or nude content of anyone;
   • harass, bully, shame, threaten or defame anyone;
   • create political, election or public-event misinformation;
   • commit fraud, scams or identity theft;
   • present any output as real evidence or real footage — including presenting a "Santa caught on camera" clip as real security footage for any purpose other than harmless holiday fun; or
   • sexualise, exploit or endanger minors in any way.
7. Reporting and fast removal. Every online card has a Report this card link, and anyone can email support@aichristmas.io. We review reports within 24 hours and may disable content immediately while we review.
8. Immediate enforcement. When a violation is confirmed, we delete the content and the photos used to make it, disable any card link, and suspend or terminate the account. Accounts terminated under these rules lose remaining credits without refund, and we may refuse future use. For sexual content involving real people or any content involving the exploitation of minors, we terminate the account immediately and report it to the relevant authorities (including NCMEC where applicable). We keep only the records needed to cooperate with law enforcement.

Respect for Intellectual Property

We work to avoid infringing anyone's rights:

• Our scenes, card designs, motions and on-site copy are original to us. We do not use third-party characters or brands (for example Disney characters, the Grinch, or Elf Yourself).
• Background music uses public-domain compositions in public-domain recordings.
• You may not upload, or ask us to recreate, copyrighted characters, logos or artwork.

Rights complaints. If you believe content made with the service infringes your copyright, trademark, privacy or right of publicity, email support@aichristmas.io with the subject "Rights complaint" and include: your name and contact details; the work or right you hold; a link to the content (for example https://aichristmas.io/c/...); and a statement that you believe in good faith the use is not authorized and that your notice is accurate. We review complaints within 24 hours, remove infringing content, and terminate repeat infringers.

AI-Generated Output

Everything the service produces is AI-generated and may contain imperfections. Results are not guaranteed to be a perfect likeness. When you share content, follow the AI-content labeling rules of the platform you post on, and never present it as a real, unedited photograph or recording of real events.

Subject to these terms and to the rights of the people pictured, you may use your creations for personal, non-commercial purposes such as sharing with family and friends and printing holiday cards.

Data Deletion

To protect you and your family, all user content is deleted automatically within 7 days: uploaded photos, generated photos and videos, watermarked previews and online cards (card links stop working after 7 days). You can delete any of it sooner in My Creations. Our AI processing providers receive your photos only to complete your request; we copy each result into our own storage as soon as it is ready and delete it there within 7 days. We never use your photos or creations to train AI models. Details are in the Privacy Policy.

Credits, Payment and Refunds

The first Christmas photo preview is free. Paid features use credits bought in one-time packs — no subscription:

Credits work for every feature and don’t expire. One HD photo uses 1 credit; one video uses 10 credits. Prices are in US dollars. Payments are processed by our payment partner, which acts as merchant of record; we never see or store your full card details. If a generation fails, its credits are returned automatically. Refunds follow our Refund Policy.

Termination

You may stop using the service at any time and ask us to delete your account. We may suspend or terminate access for violations of these terms, as described above.

Disclaimers

The service is provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee uninterrupted availability or that every generation will meet your expectations.

Limitation of Liability

To the extent permitted by law, our total liability for any claim related to the service is limited to the amount you paid us in the 3 months before the claim. We are not liable for indirect, incidental or consequential damages.

Changes to These Terms

We may update these terms. We will post the new version here with a new date; material changes will be highlighted on the site. Continued use after a change means you accept it.
